First thing that is important here is your ship date. because If your sworn in yet your process will be put on hold until you clear this case as well as complete whatever sentence you receive. You will must likely have to do a military required interview questioning your alcohol status (since you are a minor). That part is not a big deal. You can have 2 misdemeanor alcohol charges but overall you DO NOT WANT THEM ON YOUR RECORD. THEY AFFECT YOUR SECURITY CLEARANCE. Personally my SC cut mos options from like 40 to 10. I know all this information because I also had 2 misdemeanor charges for minor pos of alcohol. When you go to court if you plead no contest you will most likely get a lowered charge of around $100-$150 dollars. If you want to plead not guilty you will have another court date to argue your case. If you have a lawyer it will likely get dropped.

On a side not my friend. You are who you hang out with. I leave sept 1st and about a month ago I recieved a charge for fake Id b/c I decided to go hang out with some friends at a beach and get trashed. If you want to drink man wait till your of age. No offense if you are telling the truth about your story but I have no clue why a officer would give you a minor possesion charge if he didn't see you with a drink or reasoning... Go look at my post when I was in trouble not 3 weeks ago. If your like me and all you want is military in your future lets act like it brother.
This post made me feel much better thanks. And yes I do know who I hang out with and my friends we aren't the partying type I moved past that my first minor in possession charge because I thought having an A&B charge and a minor possession charge would really mess things up. The town I live in have the worst kind of cops imaginable they have nothing better to do and even though what I did was illegal if I was in a different town they definitely would have let me and my friends go considering we are all wanting to enlist. Tomorrow when the D.A. gives me a call I'm going to explain my case and have him talk to a family friend who is a E-8 and hopefully things will go my way. All I want to serve and this was another wake up check for me knowing that I can't be around this kind of stuff no more because this sorta stuff like this happens and I feel bad because my recruiter has been working with me since Sept 09 and I feel like I let him down again so I feel like I'm letting him down to.

Your going to be fine. But strive to get the charged drop for mos reasoning like I said. As I was told remember not to use the military as your direct reasoning for getting out of a charge. If you didn't do anything wrong and was not in possession of alcohol use that as your main agrument and note strongly that the misjudgement would lead to further holding on you military contract pursuit. Do you have any clue of exactly what your wanting your mos to be?

I want to be a 13F and yes I know I'm going to explain my case and tell them that this might change things for my enlistment and I'm giving the D.A. my recruiters number to talk to him but I am going to be truthful state the facts and try to get this thing dismissed but I hear that is you get a continuance without a finding it still looks guilty in the eyes of the military so I don't know if I should plead guilty if they try and give me one of those.

Don't forget to let us know what happens with the DA, your Recruiter & your attempt to enlist.

Good luck to you. I know you want to serve.

Just throwing in my personal experience in here, about a month ago I received a DUI,MIP, and a traffic ticket ( stupid mistake, I know) and I feared that I wouldn't be able to enlist because of the penalties that go with the charges probation, alcohol classes, fines etc... but I worked with my recruiter and our D.A. and after talking with the arresting officer he agreed that because I didn't give him any problems that he was willing to reduce the ticket to just a public intox ticket now I have to serve three days and jail and about a 700$ fine and then I'm clear to go. So keep your head up about it and I hope the best for ya!

Jgrillo, please try to stay away from trouble from now on. Stay away from friends that have booze or drugs or could have them, don't speed, be nice to your girlfriend, relax, start reading books or watching TV and don't go to places where 'something could happen' and generally adopt an attitude of rightousness. Perhaps the DA lets you slide. Then, if you make it into the Army, do the same as above and you will be OK.

That is why me and my friends decided not to go into any more "happening spots" in the town but still have fun, and we are doing our own Army PTs that our recruiters do with us to keep are mind off that sorta lifestyle because the Army means a lot to my friends and it is not worth not making it because of the HUGE party that we'll miss so I have support from my friends and some of my girlfriends. Not to mention I got Battlefield Bad Company 2 to keep my mind off of things like that. This actually motivated me not to do stupid things like this again because it is NOT worth it. And thank you Master Tanker. I sure to let everyone knows how it goes with the D.A. and my enlistment.
